Standard terms and conditions of sale for consumer purchases of goods over the Internet
(Based on the Norwegian Consumer Authority's standard terms and conditions and the Act on the Duty of Information and Right of Withdrawal)
1. The Agreement
This purchase is governed by these terms and conditions together with the information in the order form.
Mandatory provisions of consumer law take precedence.
2. The parties
Seller:
The online store ArtArctic.no owned by Tim Rogožin ENK, organization number 936 014 089.
The store represents the brand ArcticPeople-Design, where Tim Rogožin is also a co-owner.
All textual content, design and images on the website belong to the companies Tim Rogožin ENK and ArcticPeople AS and may not be copied or used without written permission.

3. Price
All prices are stated in Norwegian kroner (NOK) and include value added tax (VAT).
Final prices for special orders and B2B orders are determined by the seller after detailed agreement and confirmation of the order.
Shipping costs are not included in the item price displayed on the website.
The total price including all taxes and shipping is shown in the shopping cart.
The buyer shall not bear costs that are not disclosed prior to purchase.
4. Conclusion of the agreement
The agreement is binding on both parties once the buyer has sent their order to the seller.
However, the agreement is not binding if there has been a typing or typing error in the seller's offer in the ordering solution in the online store or in the buyer's order, and the other party realized or should have realized that there was such an error.
5. Payment
When paying by card, the amount is reserved when ordering and is charged when the item is shipped.
Available payment solutions: debit and credit cards, Vipps, Klarna.
For legal entities, payment can be made against invoice within 14 days after the goods have been shipped or delivered, unless otherwise agreed in advance.
For special orders, the seller may require partial or full advance payment. In such cases, the payment terms will be agreed in writing between the parties during the ordering process.
6. Delivery
Delivery is considered to have occurred when the goods have been received by the buyer or his representative.
Production and delivery time:
Production and delivery to Bring/Posten of standard T-shirts with printing takes place within 2–3 days.
Production and delivery of textile products (sweaters, hats, headbands) takes place within 2–5 days.
If for special reasons the seller cannot ship the item within the specified time, the buyer will be informed on the same day the order is received.
Freight:
Delivery within Norway is carried out according to Bring/Posten's rules and usually takes a maximum of 7–10 days.
Mail from Mehamn is sent twice a week, and during the winter there may be delays due to weather and road conditions.
Delivery outside Norway is via international carriers and normally takes 10–14 days depending on the country. In difficult weather conditions or force majeure, the delivery time may be extended to 30 days from dispatch.
Free pickup at our store in Mehamn is possible.
For some locations in Finnmark, delivery may be via courier; this will be informed separately.
For purchases over 1200 NOK, "Package home in the mailbox" is covered by the seller.
7. The risk of the goods
The risk for the goods passes to the buyer when he, or the buyer's representative, has received the goods in accordance with clause 6.
In the event of a defect or damage to the item, the buyer is asked to contact customer service as soon as possible.
8. Right of withdrawal (returns when shopping online)
Buyer can cancel the purchase after Right of Withdrawal Act within 14 days.
The deadline runs from the day after receipt of the goods.
The buyer must give written notice of return by email and send the item back to the seller.
Returns must be made no later than 14 days after written notification of the right of withdrawal.
The seller will refund the purchase price without undue delay and no later than 14 days after receipt of notification and return.
The seller may withhold payment until the item has been received or the buyer has documented the shipment.
Return costs are borne by the buyer, unless the return is due to a fault or defect in the item.
The customer is responsible for checking sizes before ordering to ensure correct fit.
Size charts can be found on the product pages, and we recommend using them to avoid ordering incorrectly.
If you cannot find the size chart for a specific product, please contact us before ordering for advice.
Exceptions, important for textile products:
Goods made to the customer's specifications or with a clear personal touch (e.g. special embroidery, printing, monogram, personalization) - are not covered by the right of withdrawal, cf. Section 22 of the Right of Withdrawal Act.
9. Delay and non-delivery – buyers' rights and deadline for filing claims
If the seller does not deliver the goods or delivers them late in accordance with the agreement between the parties, and this is not due to the buyer or circumstances on the buyer's side, the buyer may, in accordance with the rules in Chapter 5 of the Consumer Purchase Act, withhold the purchase price, demand fulfillment, terminate the agreement and/or demand compensation from the seller, depending on the circumstances.
When claiming default powers, the notification should be in writing (for example, email) for evidentiary reasons.
Raising
If the seller does not deliver the goods at the time of delivery, the buyer shall encourage the seller to deliver within a reasonable additional period of performance. If the seller does not deliver the goods within the additional period, the buyer may cancel the purchase.
However, the buyer may cancel the purchase immediately if the seller refuses to deliver the goods. The same applies if delivery at the agreed time was decisive for the conclusion of the agreement, or if the buyer has informed the seller that the time of delivery is decisive.
If the item is delivered after the additional deadline set by the consumer or after the time of delivery that was decisive for the conclusion of the agreement, a claim for cancellation must be made within a reasonable time after the buyer became aware of the delivery.
Replacement
The buyer may claim compensation for losses suffered as a result of the delay. However, this does not apply if the seller proves that the delay is due to an obstacle beyond the seller's control that could not reasonably have been taken into account at the time of the agreement, avoided, or the consequences of which could not have been overcome.
10. Defects in the product – the buyer's rights and complaint period
If the goods have a defect, the buyer must, within a reasonable time after the defect was discovered, and no later than two months, send a written notification of the complaint to the seller.
If the defect is not due to the buyer or circumstances on the buyer's side, the buyer may, under Chapter 6 of the Consumer Purchase Act, withhold the purchase price, demand correction or replacement, demand a price reduction, cancellation and/or compensation.
Complaints should be submitted in writing.
Correction or resubmission:
The buyer may demand rectification of the defect or delivery of a similar product. The seller may refuse if this is impossible or entails unreasonable costs. Rectification or replacement shall take place within a reasonable time. The seller is not entitled to more than two attempts to rectify the same defect.
Price reduction:
The buyer may demand a price reduction if the goods cannot be repaired or replaced. The ratio between the reduced price and the agreed price shall correspond to the ratio between the value of the defective goods and the value of the goods as agreed. If special reasons exist, the price reduction may be determined according to the importance of the defect for the buyer.
IMPORTANT INFORMATION
All our textile products and the website contain information about necessary maintenance rules (washing, drying and ironing). In case of violation of these rules, complaints from the buyer will not be accepted.
If defects occur despite correct maintenance, the buyer must submit a written complaint with photos.
We therefore emphasize that it is important to follow the maintenance rules carefully.
11. The seller's rights in the event of the buyer's default
If the buyer does not pay or fulfill his other obligations under the agreement or the law, and this is not due to the seller or circumstances on the seller's side, the seller may, in accordance with Chapter 9 of the Consumer Purchase Act, withhold the goods, demand fulfillment, cancellation and/or compensation. The seller may also demand late payment interest, collection fees and a reasonable fee for uncollected goods.
Fulfillment
The seller can maintain the purchase and demand payment. If the goods are not delivered, the seller loses the right if he waits an unreasonable amount of time to file the claim.
Raising
The seller may cancel the agreement in the event of a material default in payment or other material breach by the buyer. The seller may not cancel if the full purchase price has been paid. If the seller sets a reasonable additional deadline and the buyer does not pay within the deadline, the seller may cancel the purchase.
Interest and debt collection
In the event of late payment, the seller may claim interest under the Late Payment Interest Act. If payment is still not made, the claim may, after notice, be sent to debt collection. The buyer may then be liable for fees under the Debt Collection Act.
Fee for uncollected, non-prepaid items
If the buyer fails to collect unpaid goods, the seller may charge a fee that will not exceed the actual cost of delivery. Such a fee cannot be imposed on buyers under the age of 18.
12. Privacy and processing of personal data
ArtArctic.no is committed to protecting your privacy and processes all personal data in accordance with applicable data protection legislation (GDPR).
We only collect information that is necessary to process orders, such as name, address, email address, and payment information.
This information is used exclusively to manage your order and is not shared with third parties, unless necessary to complete the order (for example, payment or shipping companies).
We never share your data with other companies for marketing purposes without your express consent.
All personal data is only stored for as long as necessary for the purpose, such as accounting, customer service or statutory retention.

The website uses cookies to give you a better and more personalized user experience.
Cookies are used, among other things, to remember settings, analyze traffic and improve functionality.

13. Conflict resolution
Complaints must be addressed to the seller within a reasonable time, cf. points 9 and 10. The parties shall attempt to resolve any disputes amicably. If this is unsuccessful, the buyer may contact Consumer Protection Agency for mediation (telephone 23 400 600 / www.forbrukertilsynet.no).
The European Commission's complaint portal can also be used if you are a consumer residing in another EU country: http://ec.europa.eu/odr.
If the dispute is not resolved, the case may be brought before a Norwegian court, in particular Finnmark District Court, unless otherwise provided by mandatory legislation.
14. Force majeure
ArtArctic.no is not responsible for non-fulfillment due to circumstances beyond human control, such as natural disasters, fire, war, strikes, pandemics, government measures, technical failures or other events beyond the company's reasonable control.
Such conditions exempt the parties from liability as long as the situation persists.
